Il prossimo 21 maggio scadrà il termine per la presentazione del MUD 2022, il Modello Unico di Dichiarazione ambientale che fa riferimento ai rifiuti prodotti nel corso del 2021. Il nuovo modello, pubblicato in Gazzetta Ufficiale il 17 dicembre 2021, presenta delle modifiche che da un lato permettono di tenere il passo delle più recenti evoluzioni normative per produttori e gestori, dall’altro invece potrebbero rivelarsi complesse da digerire nei pochi mesi a disposizione prima della scadenza.

Il nuovo modello era da molto tempo atteso, soprattutto in seguito alla nuova classificazione dei rifiuti entrata in vigore dal primo gennaio 2021 tramite il decreto legislativo 116 del 2020. La nuova classificazione, infatti, ha rivoluzionato la categoria di rifiuti “urbani”, includendo anche un lungo elenco di rifiuti prodotti dalle utenze non domestiche. Dal 1 gennaio 2021, le aziende potevano scegliere se affidarsi a degli operatori privati o pubblici per la raccolta dei rifiuti urbani, cosa che non era possibile prima della nuova classificazione.

Questa nuova possibilità impone ai raccoglitori e ai trasportatori privati che hanno ritirato questa particolare tipologia di rifiuti di comunicare i dati attraverso la comunicazione “rifiuti urbani”. Ciò potrebbe rivelarsi una complicazione per loro, poiché dovranno presentare due differenti dichiarazioni, ovvero “rifiuti urbani” tramite il sito “MUD comuni” e quella “rifiuti” tramite il portale “MUD telematico”.

Un’altra complicazione, però, potrebbe essere quella legata alla nuova “scheda riciclaggio”, la quale dovrà essere compilata dagli impianti che in primo luogo effettuano operazioni di recupero di materia o di preparazione per il riutilizzo di rifiuti urbani e di imballaggio e, in secondo luogo, generano end of waste, materie prime seconde, prodotti, materiali o sostanze. La scheda riciclaggio chiede informazioni dettagliate, come gli scarti generati dai trattamenti preliminari alle operazioni di riciclo e dalle operazioni stesse, le quantità totali trattate nell’anno dall’impianto e le quantità trattate nelle operazioni finali di riciclo. Queste informazioni sono necessarie anche per rispettare il nuovo metodo europeo di calcolo delle performance di riciclo. Le aziende dovranno fornire i dati relativi al 2021, dati però che non sono ancora in loro possesso. Per questo motivo, il legislatore prevede a possibilità di fornire delle stime, realizzate con la migliore accuratezza possibile.

The deadline for the presentation of the MUD 2022, the Single Environmental Declaration Model (MUD) that refers to the waste produced in 2021, will expire on 21 May. The new model, published in the Official Gazette on December 17, 2021, presents changes that on the one hand make it possible to keep pace with the most recent regulatory changes for producers and managers, on the other hand they could prove to be complex to digest in the few months available before the deadline.

The new model was long overdue, especially following the new waste classification that came into force on January 1, 2021 through Legislative Decree 116 of 2020. The new classification, in fact, has revolutionized the category of “urban” waste, also including a long list of waste produced by non-domestic users. From 1 January 2021, companies could choose whether to rely on private or public operators for the collection of urban waste, which was not possible before the new classification.

This new possibility requires private collectors and transporters who have collected this particular type of waste to communicate the data through the communication “urban waste”. This could prove to be a complication for them, as they will have to submit two different declarations, namely “municipal waste” via the “MUD Comuni” site and the “waste” one via the “telematic MUD” portal.

Another complication, however, could be the one linked to the new “recycling sheet”, which must be filled in by the plants that first carry out operations for the recovery of material or preparation for the reuse of urban and packaging waste and, secondly, they generate end of waste, secondary raw materials, products, materials or substances. The recycling sheet asks for detailed information, such as the waste generated by the preliminary treatments to the recycling operations and by the operations themselves, the total quantities treated in the year by the plant and the quantities treated in the final recycling operations. This information is also necessary to comply with the new European method of calculating recycling performance. Companies will have to provide data relating to 2021, but these data are not yet in their possession. For this reason, the legislator foresees the possibility of providing estimates, made with the best possible accuracy.
